General Terms and Conditions of Use
1.- GENERAL
These General Terms and Conditions of Use contain the agreements governing the relationship between SERVALESA, LIMITED COMPANY (hereinafter, “the Company”) and the users accessing www.servalesa.com (hereinafter, “the Website”) as well as the contents that the Company makes available through them. Please read these General Terms and Conditions of Use carefully.
In compliance with the provisions of Article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, Users are hereby informed that the ownership of the Website corresponds entirely to the company SERVALESA, SINGLE SHAREHOLDER LIMITED COMPANY, with registered offices at 46930 – Quart de Poblet (Valencia) – Calle Pinadeta, 26, Spain, and tax identification number B-46164588, registered for an indefinite period of time in the Commercial Registry of Valencia, in Volume 1,025, Section 4, Folio 130 and Page 6377.
2. DESCRIPTION
Via the Website, the Company provides Users with a range of products related to their activity, among other things. It is not responsible for the application of the products outside Spanish territory, as it prioritises in all cases indications from the competent bodies in Spain.
The Company shall not be held responsible for any dispute between Users, and shall be exempt from any form of liability.
When an individual uses and/or accesses the Website they are attributed the condition of User, and this implies their acceptance, without reservation, of all the General Terms and Conditions of Use included in this document, which constitute a binding contract between the User and the Company, as well as in the Privacy Policy and in the Legal Notice of said website, regardless of whether they purchase any advertised product. If the User does not accept them, they should refrain from using the Website.
When a User accesses the Website, this does not imply any obligation on the part of the Company to check for the absence of viruses or any other harmful computer elements. It is the responsibility of the User, in any case, to have adequate tools for the detection and disinfection of these elements. The Company shall not be liable for any damage caused to the software and computer equipment of Users or third parties while the services offered on the Website are being used, nor for damages of any kind caused to the User as a result of failures or disconnections in the telecommunications networks that lead to the suspension, cancellation or interruption of the service.
The Company reserves the right to modify, add or remove any existing content that forms part of the Website. The Company has no control over the legislation of other countries in relation to advertised products, and Users should always respect the rules of use if they purchase products for use outside Spanish territory.
3.- INTELLECTUAL & INDUSTRIAL PROPERTY RIGHTS
The Intellectual and Industrial Property Rights on the Website are owned by the Company, which has exclusive rights to use them in any way, particularly the rights of reproduction, distribution, public communication and transformation. Therefore, all computer, graphic, advertising, photographic, multimedia, audiovisual and design material, as well as all content, texts and databases made available to Users, are the property of the Company.
The third-party holders of Intellectual and Industrial Property Rights over photographs, logos and any other symbols or contents included on the Website have granted their corresponding authorisation for them to be reproduced, distributed and made available to the public.
The User acknowledges that under no circumstances does acceptance of these Terms and Conditions of Use for the Website confer any rights, licences or authorisations to carry out prohibited acts. The User expressly recognises that the reproduction, modification, distribution, marketing, decompilation, disassembly, use of reverse engineering techniques or any other means to obtain source code, as well as the transformation or publication of any result of unauthorised reference tests of any of the elements and utilities integrated within the development of the Website constitutes a direct and serious infringement of the legitimate Intellectual Property Rights of the Company, and consequently undertakes not to carry out any of the foregoing actions, and the Company reserves the right to take any legal action it deems appropriate to defend its legitimate interests and rights.
The Website may contain links to third-party websites, applications, services or resources that are subject to different conditions and have their own privacy policies. The Company assumes no responsibility or liability whatsoever regarding these aspects, and its links to such services do not imply any endorsement.
4.- OBLIGATIONS APPLICABLE TO USERS
By accepting these Terms and Conditions of Use, Users agree to:
i. Use the contents of the website correctly and responsibly, refraining at all times from using them in an illicit or illegal manner, or in a manner that may infringe upon the interests of third parties.
ii. Act politely and respectfully when communicating or interacting with other Users.
iii. Not disseminate, distribute or share content that undermines fundamental rights of third parties regarding honour, image and personal and family privacy, particularly involving minors.
iv. Not disseminate, distribute or share content that promotes racist, xenophobic, obscene, pornographic, defamatory or fraudulent ideas, or anything else contrary to morality or public order. The use of offensive or profane words is also prohibited.
v. Report, as soon as possible, any infringement that they become aware of carried out by any other User, especially if they are under 18 years of age.
vi. Not gain unlawful and unauthorised access to other Users’ accounts.
vii. Not introduce computer viruses, defective files or any other software that violates computer security.
viii. Not infringe upon the Intellectual and Industrial Property Rights of the Company or third parties.
ix. Not alter, modify, manipulate or disable the content of the Website without prior written consent from the Company.
